Hearing of the appeal filed by the Senate President, Senator Bukola Saraki, seeking to stop his arrest by the Police and stay proceedings before the Code of Conduct Tribunal over alleged false assets declaration has now been fixed for October 6.

The proceedings was stalled following the death of Justice Abdulkadir Jega, the presiding judge of Abuja Division and Justice Muss Hassan Alkali of the Ilorin Division, who were victims of the stampede in Mina, Saudi Arabia that claimed many lives.

‎The Court of Appeal had adjourned hearing of the motion on notice till September 29 following its earlier directive ‎that the appellant should notify the respondents.

The Court of Appeal and the Federal High Court sitting in Abuja, in two separate rulings, had refused the ex-parte applications brought by the Senate president seeking to stop his arrest by the Police and stay proceedings before the Code of Conduct Tribunal over alleged false assets declaration.

Saraki had wanted the Federal High Court to stop the Code of Conduct Bureau and Tribunal from prosecuting him on the ground that it is only the Attorney-General of the Federation that has the power to initiate criminal proceedings against him.

The Code of Conduct Tribunal had succeeded in arraigning Senator Saraki and he pleaded not guilty‎ to the 13-count charge slammed against him. (Channels TV)
