Court adjourns hearing on Osun LG tenure elongation




A Federal High Court sitting in Osogbo, Osun State, has adjourned to November 27, 2025, to hear a case brought by reinstated Chairmen and Councilors of the All Progressives Congress (APC). The suit seeks a legal determination of their tenure and challenges the validity of local government elections allegedly conducted in February 2025 by incumbent Governor Ademola Adeleke.

In the case, referenced as Suit No. FHC/OS/CS/147/2025, the claimants, led by Onibonokuta Saheed and others, are seeking clarification on whether they are entitled to a three-year term starting from February 2025. They also question the validity of the Osun State Independent Electoral Commission’s (OSSIEC) elections held on February 22, 2025, during their tenure.

The claimants joined Attorney General of the Federation, the Inspector General of Police, Osun State Governor, the Attorney General and Commissioner for Justice, Osun State House of Assembly, and Osun State Independent Electoral Commission (OSSIEC), as defendants.

They argued that they were not allowed to serve their time when they were sworn in on October 15, 2022, hence their time could not start counting in 2022

The ongoing dispute regarding Osun’s Local Government Administration has sparked public debate and litigation since the Court of Appeal reinstated the elected APC Chairmen and Councilors on February 10, 2025.

During the hearing yesterday, counsel to the claimants, Muhydeen Adeoye, filed a motion to restrain the defendants from interfering with his clients’ duties while the case is pending.

However, lawyers representing the 3rd and 4th defendants, Barrister F.K. Labo-Popoola, the 5th defendant’s counsel, Barrister Rachael Ojomi, and the 6th defendant’s counsel, Barrister J.A. Ayanyemi, contended that they were still within the timeframe to respond to the main summons.

Justice Adefunmilola Demi-Ajayi, who presided over the case, noted that service of documents is incomplete and instructed the counsel to ensure that all parties are properly served before the next adjournment date.

Reiterating her commitment to an expedited resolution of the case, Justice Demi-Ajayi set the next hearing for November 27, 2025. (SUN)
