The Peoples Democratic Party (PDP) has accused the Speaker of the Kano State House of Assembly, Hon. Yusuf Ata of disobeying an order of the Supreme Court.
The court had on July 12 delivered judgment in a case concerning the seat of Kura/Garun-Mallam constituency.
The apex court, in Appeal NO: CA/K/225/2015, SC.957/2015, upheld the judgment of the Court of Appeal, Kaduna Division delivered on November 27, 2015.
It held that the appeal was completely devoid of merit and ordered the third appellant, Mr Hayatu Sallau to vacate the seat of the Kura/Garun Mallam constituency at the Assembly.
The Supreme Court had also ordered the Independent National Electoral Commission (INEC) to withdraw the Certificate of Return issued to Sallau and issue same to the runner-up in the general election into the Assembly.
The court had directed the Speaker or the Clerk of the House of Assembly to swear in the runner-up in the said election.
In a statement signed on Sunday by the PDP National Publicity Secretary, Dayo Adeyeye, the party said INEC had complied with the judgment by issuing a Certificate of Return to its candidate, Abdullahi Muhammed.
They, however, noted that the Speaker was yet to comply with the order as Muhammed had not been sworn in, 26 days after the judgment.
“The Speaker has blatantly refused to swear in our candidate. We call on the Governor of Kano State, the Attorney General of the Federation and all well-meaning Nigerians to prevail on the Speaker of the Kano State House of Assembly to obey the rule of law and to perform his constitutional duty by swearing in Mr Abdullahi Mohamed without further delay.” (Channels TV)
