A Kano State High Court sitting on Miller Road has adjourned until November 13, 2026, the medical negligence suit against the Abubakar Imam Urology Centre following the absence of the government’s lawyers and the defendants’ failure to file their defence within the time prescribed by the court.

The suit arose from the death of Aisha Umar, who died in September 2025 while undergoing corrective surgery to remove a pair of scissors allegedly left inside her abdomen during an earlier operation at the facility.

At the resumed hearing, counsel to the plaintiff, Barrister Faiza Yunusa Yusuf, expressed frustration over the delay.

She told Daily Trust that the defendants neither filed their defence nor appeared in court.

“We are waiting for the defendants to file all their processes and appear in court to defend the case. Unfortunately, there was no legal representation for the defendants, and they have not filed their processes. Their time for doing so has elapsed,” she said.

Yusuf explained that under the Kano State High Court (Civil Procedure) Rules, the period allowed for filing a defence had expired, prompting the court to adjourn the matter until November for proof of the plaintiff’s case.

The deceased’s husband, Abubakar Muhammad, expressed disappointment over what he described as the state government’s lack of commitment to the matter.

“I feel dissatisfied and unhappy with the position the state government has taken. They set up an investigative committee in January, and up till now, the committee has not released its report. I don’t know why the state government is dragging its feet on the matter,” he said. (Daily Trust)
