Candidate of African Democratic Congress (ADC) in last year’s Anambra Central senatorial election, Comrade Anayo Nweke, has dragged the Independent National Electoral Commission (INEC) to court, urging it to stop former Governor Peter Obi the Peoples Democratic Party (PDP) from taking part in the rescheduled election, for which a date is yet to be fixed.
He also wants the Federal High Court sitting in Awka to restrain INEC from fixing a date and conducting any fresh election for Anambra Central without the conclusion of the pending appeal proceedings between PDP and the candidate of All Progressives Grand Alliance (APGA), Chief Victor Umeh.
In the suit number FHC/Awk/CS/69/2016 dated 12th April, 2016, the plaintiff sought for a declaration that it is only the candidates/political parties that participated in the first election that can participate in the fresh election as ordered by the Court of Appeal, Enugu Judicial division.
Nweke further sought for a declaration that INEC cannot validly conduct a fresh election in Anambra Central Senatorial district for the 2015 election without the conclusion of the appeal in the matter between Umeh and PDP.
