Daniel Penny, the perpetrator of the fatal choking of Jordan Neely on a New York City subway train, surrendered himself to police on Friday.

The Marine veteran, 24, has been charged with second-degree manslaughter in connection with the chokehold death of the homeless Black man in early May.

Penny’s attorney, Thomas Kenniff, said that the case will now go to court and that an arraignment is expected on Friday afternoon.

According to reports, Neely, 30, who was experiencing mental health issues, was shouting at other subway passengers.

Penny's defense lawyers argued that Neely was "threatening" other passengers on the subway, and that Penny did not intend to cause him harm.

Penny was released on the day of the incident after questioning by the police. However, video footage of the fatal incident surfaced and led to outrage and protests. (Anadolu Agency)
