The Court of Appeal sitting in Sokoto on Saturday upheld the judgement delivered earlier on April 17, 2019 by the Federal High Court Birnin-Kebbi under Justice Sunday Onu Bassey that affirmed the primary election of the All Progressives Congress (APC) conducted in Kebbi South senatorial district that led to the victory of Senator Bala Ibn Na’Allah as validly elected to represent Kebbi South senatorial district at the 9th National Assembly.
The appeal filed by Prince Sule-Iko Sami was dismissed by the judges of the said appellate court under the panel of Justice Ahmad Belgore. The petitioner had similarly lost at the lower court.
While delivering judgement today in Sokoto, Justice Frederick Oho said: “The appeal panel judges unanimously agree that the appeal filed by the appellant lacks merit and the appeal is hereby dismissed accordingly without no cost and the judgement of trial court is hereby affirmed.”
In an interview with council to the first respondent Barrister Sanusi Samaila Jega, who is also holding the brief for second respondent counsel to Senator Na’Allah, expressed their satisfaction over “the sound judgement delivered by the justices of the Court of Appeal Sokoto Division”, adding: “This shows that the judicial system is still in good frame.”
Council to the appellant Sule-Iko Usman Aliyu was not seen in court and hence could not be reached for comment.
