Kano State Complaints and Anti-Corruption Commission has said that there is no court order that stopped it from carrying out investigation into alleged misappropriation of Emirate council funds.

According to a statement by the Executive Chairman of the commission, Muhuyi Magaji, the only court order privy is the interim injunction by a state high court on the arrest of three Emirate Council staff members.

“There is no court order that prevents the commission from carrying out an investigation into alleged misappropriation of Kano Emirate council funds, and as a matter-of-fact, the commission did not receive any court order that stops us from conducting our statutory responsibility.

“What we know as far as the commission is concerned is that, there is an order that directed the commission to maintain the status quo regarding to the arrest warrant issued against three (3) Emirate Council staff.”

Mr Magaji stated that the commission had earlier obtained an order from a Chief Magistrate Court to arrest the three suspects, but had acknowledged the court order.

“Nevertheless, the commission acknowledged a State High Court interim injunction to maintain the status quo regarding to the arrest not to stay all action, which refrain the commission from arresting them, and in that regard the suspects are out there enjoying their freedoms.”

He added that the court is not in the position to stop the commission from carrying out its statutory responsibilities.

“We believe that it is not even within the powers of the court to stop a statutory agency from performing their statutory responsibility. Hence, the commission will continue to obey the law as always.” (Channels TV)
