Court adjourns suit seeking to stop Anambra governorship election

The Federal High Court Awka presided over by Hon. Justice I.B. Oweibo on Tuesday adjourned to December 14, 2017 the suit seeking to stop the Anambra State governorship election scheduled for this Saturday, November 18, 2017.

The suit was instituted by a Human Rights Lawyer and President of Voters Rights International, Barrister Jezie Ekejiuba, against the Independent National Electoral Commission (INEC).

At the commencement of hearing, Barr. Ekejiuba, who appeared for himself, informed the court that INEC has been duly served with all the court processes and prayed for leave of court to argue his Motion for interlocutory injunction.

But Counsel for INEC, T.M. Inuwa Esq., who appeared with E.E Udeh Esq., opposed the hearing, contending that the suit is not ripe for hearing on the grounds that the time allowed by the of court for them to defend the suit is still running and therefore entitled to an adjournment to file their counter affidavit and substantive defence to the action in the interest of fair hearing. The suit marked FHC/Awk/CS/154/2017 is seeking for Order that any general election in Nigeria, including the forthcoming Anambra governorship election or any other date conducted by the Defendant, INEC, while still excluding all formerly deregistered political parties restored back to life by Court of Appeal decisions/judgement orders secured in Barrister Jezie Ekejiuba v. INEC & Anor Appeal No. CA/E/170/2014 is null and void and of no effect pursuant to Section 287(2) of the 1999 Constitution of Nigeria as amended.

Addressing newsmen after the court proceeding, Barr. Ekejiuba said that the fact that matter was adjourned in favour of INEC to conduct Anambra governorship election does not affect the final outcome of the suit because if the suit is successful it will operate to nullify the final outcome of any general election conducted by INEC and the winner must vacate office empty handed as it happened to Senator Andy Uba who was sent packing from Anambra State Government, House, Awka, in 2007.
