An Oyo State High Court sitting in Ibadan on Friday dissolved the marriage between Mary and Temitope Amos, over infidelity leading to Sexually Transmitted Disease (STD) and miscarriages.
Delivering judgment, Justice Mojisola Sule said the petitioner, Mary, had in 2024 sought the dissolution of the marriage contracted on Aug.19, 2017.
The petitioner also sought accommodation, welfare and maintenance award for the female child of the marriage.
She also prayed that the debt of N400,000 which the respondent (Temitope) borrowed from her be paid.
The petitioner’s Counsel, Mr Niyi Oshimubi, had prayed that the marriage be dissolved as the parties lived apart for more than three years.
He sought the dissolution on the ground of infidelity of the respondent which caused the petitioner various STD and five miscarriages medically proven.
Justice Sule granted the petitioner’s prayers and dissolved the marriage under Section 15(f) of the Matrimonial Causes Act.
Considering the well-being and upkeep of the child, Sule ordered that she should remain in the petitioner’s custody.
She ordered N100,000 award monthly for the child’s maintenance and N500,000 award for accommodation.
The judge also awarded the petitioner the debt of N400,000 which the respondent borrowed from her.
She, however, directed that the respondent be granted reasonable access to the child. (NAN)
