The Lagos State High Court, Yaba has restrained a firm, Oretol Nigeria Limited, and Adewale Oladapo from trespassing, selling, or dealing with a disputed four-hectare parcel of land located at Hampton Estate (also known as Eletu Odibo Island), Osapa, Eti-Osa Local Government Area.
Justice E.O. Ashade gave the order while ruling on a motion ex parte dated 13 March 2025, filed by Capital Gardens Limited against the duo and others.
The claimant, Capital Gardens Limited, sought the order to prevent the defendants, Oretol Nigeria Limited and Adewale Oladapo, from interfering with the property in question, which is delineated in survey plan no: FAI/3454/A01/2024/LA, prepared by registered surveyor A.I. Fashina on 8 February 2024.
Apart from restraining the defendants, the court also prohibited their representatives from entering, trespassing, or dealing with the disputed land in any way that interfered with the claimant’s interests.
The judge barred the defendants from marketing, selling, transferring, or assigning the land to third parties pending the determination of the suit.
Furthermore, the court directed Capital Gardens Limited to file an undertaking to comply with the pre-action protocol before proceeding further with the case.
Further hearing in the case has been adjourned to 2 June 2025 for a report on compliance. (Daily Sun)
