I am still pondering why a Judge of the Federal High Court Abuja should make an Order restraining or preventing the Rivers State Government from receiving the constitutionally guaranteed monthly Federal allocation Funds due for the benefits of Rivers State people.
Methinks that every court is not only a court of law but also a court of public policy. That is why many good judges most times intervenes to settle certain special cases for the overall benefit of the larger society.
This Rivers State monthly Federal allocation Funds are meant among other essentials for the payment of salaries and pensions of civil servants and for the payment of contractors and security services etc. The subject matter which is the public funds are not personal properties or funds of Governor Fubara rather the funds belongs to Rivers State people as a whole.
If this is the case why should the judge not apply public policy principle rather than strict legal principle to refuse the draconian Order.
I am happy that the Rivers State Government has appealed against this judgment Order aimed at bringing the third arm of Rivers State Government to a standstill.
Influential voices such as NBA should speak out to say no to this Wike vs. Fubara judicial Excesses/Order!
