INEC approaches Supreme Court on Anambra senatorial seats

The Independent National Electoral Commission (INEC) is asking the Supreme Court to clarify the political status of Senators Andy Uba, Stella Uduah and other lawmakers representing Anambra State on the platform of the PDP.

In a motion on notice dated February 5, 2016 and filed by a team of lawyers led by Mr Adegboyega Awomolo, the INEC formulated six issues for clarification.

In urging the apex court to review its judgment in the interest of justice, INEC said that it was confused on the step to follow.

The motion, which was brought under Order Eight Rule 16 of the Supreme Court Rules, 1999, Section 22 of the Supreme Court Act, 2004 and Section Six (six) of the 1999 constitution, had a 10-paragraph affidavit of urgency attached to it.

Meanwhile, the main motion has a deposed affidavit of 19 paragraphs, all deposed to by a lawyer in the law firm of Awomolo, Ebuka Nwaeze.

This is coming after a panel of the Supreme Court justices recognised the list originally submitted by the Ejike Oguebego-led state executive committee of the Peoples Democratic Party (PDP).

In its judgment delivered on January 29, 2016, the court affirmed the ruling of the Federal High Court, which held that only the constitutionally-recognised state party executive led by Mr Oguebego could organise the party primaries.

No date has been fixed for hearing the motion. (Channels TV)
