The Chairman of the Nigerian Bar Association, NBA, and Barrister Hassan Maidawa Garba has raised a serious concern over the 2022 amended Electoral Act which he said may cause scripts in the adjudication of cases.
At the NBA week in Yola, Barrister Maidawa said that there might be some bubby traps in dispensing with the cases since the electoral Act has expunged the dispensation of electoral cases from State judiciary to Federal High courts and Appeal Court. He said this was an aberration because most of the cases would not be dispensed on time.
Barrister Garba who is the NBA chairman in Adamawa State revealed that until the electoral Act is reviewed to allow State courts to handle election cases it would be difficult to handle these cases within the time limit.
He narrated that the electoral Act 2022 has caused disruption in the system if allowed to continue without amendment’s this is one factor that has made so many cases to be pending in the Federal high courts across the country and to dispense with these cases before elections in February.
According to him, the National Assembly should look into the possible ways of reviewing the electoral Act 2022 before elections.
He said the NBA has been discussing these things and possible ways of finding solutions as these cases currently pilling in the Federal High courts since the primaries cannot be dispensed with before the elections.
