Jumbo Islamic Bank Loan: Thousands storm court to hear suit against Gov. Nyako

A huge crowd of Adamawa State indigenes estimated at over a thousands yesterday stormed the old High Court premises in Yola where Justice Hafsat Abdulrahman of Court 8 is presiding over the suit filed against Governor Murtala Nyako, the Adamawa State Government and the Adamawa State House of Assembly in connection with the jumbo Islamic Bank loan which the governor is seeking to take.

The action by by Engineer Albert Stephen, Dr. Penni Boga and Dr. Francis Zira intends to stop the state government from accessing a hefty loan of $24 million from the Islamic Development Bank. The plantiffs are asking the court to declare the decision as unwarranted, unreasonable and unconstitutional considering the high financial indebtedness of the state.

The indigenes came to lend their support to the action. As early as 7:30 a.m. the premises of the High Court was filled to capacity by people from various walks of life.

When the case was mentioned, F.D. Kozah Esq appeared for the plantiffs, while Konleganyiga U.J.Esq appeared for the Adamawa State Government, Governor Murtala Nyako and the Attorney General and Commissioner for Justice, while Abubakar Sa’ad Esq appeared for the State House of Assembly.

Kozah informed the court that the matter is for mention and that the defendants have filed their memorandum of appearance, but had not filed their statement of defence.

He further informed the court that they are still within time to file their statement of defence and other processes required by the rules of court.

He said that in the circumstances, the court should adjourn the case to a suitable date to enable the defendants file their statement, if any.

The defendants conceeded and Justice Hafsat Abdulrahman accordingly adjourned the case to December 9 for mention.

The judge based the long adjournment on the need for her to travel abroad for medical attention.

According to Barrister Kozah, the position of the law is that once a suit is pending, parties should maintain the status quo and are expected to refrain from doing anything that will foist res.
